SECTION 504 POLICY AGAINST DISCRIMINATION BASED ON HANDICAP AND HANDICAP AND DISABILITY PROCEDURES

In accordance with 24 CFRSection 8, Nondiscrimination based on Handicap or Disability in federally assisted programs and activities (Section 504 of the Rehabilitation Act of 1973 (29 U.S.C. 794) and Section 109 of the Housing and Community Development Act of 1974, as amended (42 U.S.C. 5309) the City of Eldon hereby adopts the following policy and grievance procedures.

(1) Discrimination Prohibited: No otherwise qualified individual with handicaps shall be excluded from the participation in, be denied the benefits or be subjected to discrimination under any program or activity receiving Federal Assistance including the Department of Housing and Urban Development. (HUD)

(2) The City of Eldon does not discriminate on the basis of handicap or disability in admission to or access to treatment or employment in federally assisted programs and activities.

(3) The City of Eldon will take steps to notify participants, beneficiaries, applicants and employees and potential employees including any disabled or handicapped person that the City does not discriminate on the basis of handicap or disability.

GRIEVANCES AND

COMPLAINTS

(1) Any person who believes she/he has been subjected to discrimination on the basis of a handicap or disability may file a grievance within 10 days after the alleged violation. A complaint will be filed in writing or verbally to City Clerk, Leslie Wilson, who has been designated to coordinate Section 504 compliance efforts. Alternative formats to file a grievance and requests for auxiliary aids or other services are available by contacting Ms. Wilson if needed. An investigation, as may be appropriate will be conducted by Ms. Wilson and a copy of the findings will be sent to the complainant within 30 working

days. Ms. Wilson will maintain the files and records of the City of Eldon relating to the complaint file.

(2) The complainant can request a reconsideration of the case if he or she is dissatisfied with the determination as shown in (1) above within 10 days of receiving the determination.

These procedures shall be construed to protect the substantive rights of interested persons to meet substantive rights of interested persons and assure that the City of Eldon will comply with Section 504, Federal and HUD regulations.
