NOTICE UPON ORDER FOR SERVICE BY PUBLICATION

 

TO ALL PERSONS INTERESTED IN THE LAKE OF THE OZARKS AREA BUSINESS DISTRICT OF CAMDEN COUNTY,

LAKE OF THE OZARKS AREA BUSINESS DISTRICT OF MILLER COUNTY,

AND LAKE OF THE OZARKS AREA BUSINESS DISTRICT OF MORGAN COUNTY

You are hereby notified that on June 25, 2024, the Supreme Court of Missouri in Appeal Nos. SC100076 & SC100083, declared the Missouri Statutes that provided for the creation of the above Business Districts to be “constitutionally invalid and void in their entireties.” Further, the cases were remanded to the Circuit Court to “wind up and dissolve the Camden County and Miller County lake area business districts.”

The Circuit Court has set a Hearing Date of Monday, April 14, 2025, at 9:30 a.m. to hear and determine any Claims that any persons, companies, corporations or other entities may have. The Hearing shall be conducted at the Miller County Courthouse, 2001 Highway 52, Tuscumbia, Missouri 65082.

You are further notified that all Claims must be filed not later than Friday, April 4, 2025, or be forever barred. Any such claim must be filed with the Circuit Court of the respective County: Camden County Case No. 20CM-CC00106 or Miller County Case No. 20ML-CC00023. Any claim related to the Lake of the Ozarks Business District of Morgan County may be filed in either Case. All claims will be considered and determined together on the above hearing date.

All claims must include: (1) the name, address and telephone number of the claimant; (2) the amount claimed; (3) a detailed statement of the basis for the claim; (4) the date(s) on which the events on which the claim is based occurred; and (5) documentation in support of the claim.
