In re: BEMACK PROPERTIES LLC, a Missouri limited liability company

SUCCESSOR TRUSTEE'S SALE - Default having been made in the payment of certain monthly installments due under a Note described in and secured by a Commercial Deed of Trust, Security Agreement, Fixture Filing and Assignment of Leases and Rents (the “Deed of Trust”) executed by BEMACK PROPERTIES LLC, a Missouri limited liability company, dated March 29, 2021, and recorded April 5, 2021 in Book 2021, Page 1685 in the office of the Recorder of Deeds for the County of Miller, State of Missouri, and whereas the legal holder of the Note has exercised its option to declare all unpaid debt evidenced by said Note immediately due and payable, Trustee Services, Inc., the undersigned  Successor Trustee, at the request of the legal holder of said note, will on May 15, 2023, between the hours of 9 o'clock a.m. and 5 o'clock p.m. (1:00 P.M.), at the South Door of the Miller County Courthouse, 2001 Highway 52 in Tuscumbia in the County of Miller, State of Missouri, sell at public vendue to the highest bidder for cash, the following real estate described in said deed of trust and situated in the County of Miller, State of Missouri, to-wit:

TRACT I:

That part of Lot No. 11 of CHICKEN ROOST SUBDIVISION, a subdivision of Miller County, Missouri, per plat recorded in Plat Book 2, page 18 described as follows: From an existing iron pin located near the 660 contour line of the Lake of the Ozarks, at the Southeast corner of said Lot No. 11, run North 37 degrees 20 minutes West 105.7 feet, the center of a 12 foot driveway for the Point of Beginning; thence following the centerline of said driveway, run South 49 degrees 02 minutes West 100 feet; thence run centerline of said driveway North 9 degrees 17 minutes East 82.0 feet; thence run North 63 degrees 19 minutes East 40 feet; thence run North 86 degrees 16 minutes East 90 feet, to the Northeast line of said Lot No. 11 thence run South 37 degrees 20 minutes East, 18.8 fee to the Point of Beginning.

Subject to restrictions, reservations, conditions, easements and exceptions of record.

Also, all of Lot 11 of CHICKEN ROOST SUBDIVISION per plat recorded in Plat Book 2, page 18, SAVE AND EXCEPT: That part of Lot No. 11 of CHICKEN ROOST SUBDIVISION, a subdivision of Miller County, Missouri, per plat recorded in Plat Book 2, page 18 described as follows: From an existing iron pin located near the 660 contour line of the Lake of the Ozarks, at the Southeast corner of said Lot No. 11, run North 37 degrees 20 minutes West 105.7 feet to the center of a 12 foot driveway for the Point of Beginning; thence following the centerline of said driveway, run South 49 degrees 02 minutes West 100 feet; thence run South 61 degrees 37 minutes West 36.9 feet; thence run South 81 degrees 20 minutes West 42.8 feet; thence continue along the centerline of said driveway North 9 degrees 17 minutes East 82.0 feet; thence run North 63 degrees 19 minutes East 40 feet; thence run North 86 degrees 16 minutes East 90 feet, to the Northeast line of said Lot No. 11; thence run South 37 degrees 20 minutes East 18.8 feet to the Point of Beginning. ALSO SAVE AND EXCEPT that part of Lot No. 11, run North 37 degrees 20 minutes West 00.7 feet; thence run South 49 degrees 02 minutes East 94.4 feet; thence run South 37 degrees 04 minutes East 72.5 feet to the 660 contour of the Lake of the Ozarks; thence run North 71 degrees 49 minutes East 100 feet to the Point of Beginning.

Subject to the reservation by grantors of the right of ingress and egress over a strip of land 6 feet wide lying immediately South of the following described line: From an existing iron pin at the Southeast corner of Lot 11 of Chicken Roost Subdivision run North 37 degrees 20 minutes West 105.7 feet to the point of beginning of the aforementioned line; thence run South 49 degrees 02 minutes West 100 feet to the point of termination of said line.

TOGETHER WITH all improvements erected on the property, and all easements, rights, appurtenances, rents, royalties, mineral, oil and gas rights and profits, water rights and stock and all fixtures which are a part of the property, and replacements and additions to the property; for the purpose of satisfying said indebtedness and the cost executing this trust.
