WHEREAS, 4BS LOZ ENTERTAINMENT, LLC, a Missouri limited liability company, of the County of Jefferson, Missouri, by a certain Deed of Trust dated September 26, 2025, and recorded in the Recorder's Office of Miller County, Missouri, on the 29th day of September, 2025, in Book 2025 at Page 4024, conveyed to Aaron Ellsworth, Trustee, all of its right, title, interest and estate in and to the following described real estate, situated in the County of Miller, State of Missouri.

A tract of land lying in the South One-Half of Section 18, Township 40 North, Range 15 West of the 5th Principal Meridian, in Miller County, Missouri, described as follows: From the Southeast corner of Lot 40 of Section A, Block 2, Lakeland Scenic Center Community Shopping Area, a plat of said Section A, Block 2, Lakeland Scenic Center Community Shopping Area being of record in Plat Book 2 at Page 9, Miller County Recorder's Office, run South 89 degrees 20 minutes East 140 feet, to the point of beginning of the tract of land hereby conveyed; thence run South 89 degrees 20 minutes East 200 feet; thence North 0 degrees 40 minutes East 100 feet; thence North 89 degrees 20 minutes West 200 feet; thence South 0 degrees 40 minutes West 100 feet to the point of beginning.

A tract of land being a part of the South Half of Section 18, Township 40 North, Range 15 West, Miller County, Missouri, more particularly described as follows: Beginning at the Southeast corner of Lot 40 of Section A, Block 2, "Lakeland Scenic Center Community Shopping Area", a subdivision in Miller County, Missouri; thence South 89 degrees 20 minutes 00 seconds East, 110.07 feet to the Easterly right-of-way of old State Highway Route U.S. 54 and the true point of beginning; thence continuing South 89 degrees 20 minutes 00 seconds East, 29.93 feet to the Southwest corner of a tract of land as described in Book 269 at Page 735, Miller County Records, Miller County, Missouri; thence along the West line of said tract North 00 degrees 40 minutes 00 seconds East, 100.00 feet to the Northwest corner of said tract; thence leaving said West line North 89 degrees 20 minutes 00 seconds West, 30.00 feet to the Easterly right-of-way of old State Highway Route U.S. 54; thence along said right-of-way the following courses: thence South 00 degrees 40 minutes 00 seconds West, 85.91 feet to a point opposite station P.C. 614+74.7 (40ft. left); thence along a curve to the left, said curve having a radius of 1,392.59 feet and an arc length of 14.09 feet to the true point of beginning.

Subject to all easements, restrictions, reservations and conditions of record and to all existing roads and power lines, whether of record or not.

WHEREAS, pursuant to an Assignment of Promissory Note and Deed of Trust dated October 10, 2025, and recorded in the Recorder's Office of Miller County, Missouri, in Book 2025 at Page 4228, Penny L. Huston became the legal holder of the Promissory Note and Deed of Trust.

WHEREAS, by Appointment of Successor Trustee dated July 2, 2026, and recorded in the Recorder's Office of Miller County, Missouri, in Book 2026 at Page 2935, Michael L. McDorman was appointed Successor Trustee in place of Aaron Ellsworth, the original Trustee, and is now the duly appointed Successor Trustee under said Deed of Trust.

WHEREAS, said Deed of Trust was given to secure the payment of the Promissory Note described therein, and said Promissory Note has become due and is now unpaid.

NOW THEREFORE, I, the undersigned Successor Trustee, under the terms of said Deed of Trust and at the request of the legal holder of said note, will proceed to sell the above-described real estate at the front door of the Miller County Courthouse, in the City of Tuscumbia, Missouri, to the highest bidder, for cash, at public auction, on the 11th day of September, 2026, between the hours of nine in the forenoon and five in the afternoon of that date to wit: at 1:00 p.m. to satisfy said note, together with the cost and expenses of executing this trust.

 

NOTICE:

Pursuant to the Fair Debt Collection Practices Act, 15 U.S.C., Section 1692c(b), no information concerning the collection of this debt may be given without the prior consent of the consumer given directly to the debt collector or the express permission of a court of competent jurisdiction. The debt collector is attempting to collect a debt and any information obtained will be used for that purpose.
