WHEREAS, Carl Stocklein and Jacqueline Stocklein, husband and wife, by their certain Deed of Trust dated the 1st day of June, 2023, and recorded in the Recorder's Office of Miller County, State of Missouri, recorded on the 2nd day of June, 2023, at Deed of Trust Book 2023, Page 2267 conveyed to John E. Curran, as Trustee, all of their right, title, interest and estate in and to the following described real estate, County of Miller, State of Missouri, viz:
A tract of land lying in the Southwest Quarter of Section 31,
Township 41 North, Range 14 West, Miller County, Missouri, more particularly described as follows: Beginning at the Southwest corner of the Southeast Quarter of the Southwest Quarter of said Section 31, thence North 00 degrees 05 minutes 27 seconds West, 789.83 feet, (North 00 degrees 16 minutes West, 10 chains, 56¼ links, deed), to the Southerly right of way of Missouri State Highway 52; thence North 68 degrees 29 minutes East, along said Southerly right of way 189.62 feet, to an iron pin and the true point of beginning; thence leaving said right of way South 08 degrees 04 minutes East, 189.53 feet, to an iron pin on the Southerly line of said tract; thence North 75 degrees 42 minutes 59 seconds East (North 75 degrees 46 minutes East, deed) along said Southerly line 170.11 feet, to an iron pin; thence leaving said Southerly line North 00 degrees 17 minutes 42 seconds West, (North 00 degrees 07 minutes 07 seconds East deed), along the East line of a tract as described in Book 308, Page 513, Miller County Records, 13.40 feet, to an iron pin; thence leaving said East line North 70 degrees 29 minutes 53 seconds East, 198.58 feet, to an iron pin; thence North 01 degree 15 minutes 09 seconds West, 213.45 feet, to an iron pin on said Southerly right of way of Missouri State Highway 52; thence South 68 degrees 29 minutes West, along said Southerly right of way 401.91 feet, to the true point of beginning.
Subject to all restrictions, reservations, conditions, exceptions, and easements of record and to any roadways or power lines whether of record or not.
Which said conveyance was made in trust to secure the payment of a certain promissory note in said deed described, and,
WHEREAS, said note has become due and is now unpaid, and
WHEREAS, said Trustee has refused to act and said Deed of Trust provides that the holder of said note may appoint by written instrument filed of record in the Miller County Recorder's Office another Trustee in place and stead of the Trustee named therein, and thereupon, the Trustee therein named shall be discharged and the Trustee so appointed shall be substituted as Trustee hereunder with the same effect as if originally named Trustee therein; and
WHEREAS, the holder of said note has appointed Derek L . Smith of Camden County, Missouri as the Substitute Trustee therein by written instrument, filed of record with the Miller County Recorder of Deeds;
NOW THEREFORE, in accordance with the provisions of said Deed of Trust, and at the request of the owners and holders of said Deed of Trust and beneficiary of said indebtedness, the undersigned Substitute Trustee will proceed to sell the above described real estate at the front door of the County Courthouse, in the City of Tuscumbia, in the County of Miller, State aforesaid, to the highest bidder, for cash, at public auction on Friday, the 8th day of May, 2026, between the hours of nine in the forenoon and five in the afternoon of the day, to-wit: at approximately 1:00 p.m., to satisfy said note, together with the cost and expenses of executing this trust.
