NOTICE OF SALE IN PARTITION

Take notice that, on December 5th, 2025, at 1:00 p.m., on the order of the Honorable Aaron Koeppen, Circuit Judge of Miller County, Missouri, the Sheriff of Miller County, Missouri will sell to the highest bidder, for cash, real property situated in the county of Miller, Missouri described as:

An island in the Osage River known as Capps Island, located in the South half of the Northwest quarter, of the Northeast quarter of the Northwest quarter of section number one (1), Township forty (40), Range thirteen (13), and containing in the aggregate eleven (11) acres, more or less.

Also the south fractional half of the northeast quarter, and the East part of the South fractional half of the Northwest quarter, south of the Osage River, in section number two (2), Township forty (40), Range thirteen (13), containing 60 acres, more or less.

Also all of Block number two (2), consisting of eight lots, numbered one (1), two (2), three (3), four (4), five (5), six (6), seven (7), and eight (8) in Randolph Abbett’s Addition to the Town of Ramsey, as the same is platted and on file in the Recorder’s Office at Tuscumbia, Miller County, Missouri.

Also lots numbered two (2), three (3), four (4), five (5), six (6) and seven (7) in Block number three (3), and lots numbered eight (8), nine (9), ten (10) and eleven (11) in fractional Block number one (1) all in Randolph Abbett’s Addition to the town of Ramsey as per plat recorded in the Recorder’s Office at Tuscumbia, Miller County, Missouri.

Also, part of the Northwest fractional quarter of Section No. 1, Township No. 40, Range No. 13, (South of the Osage River), described as follows: Beginning at a point where Humphrey’s Creek crosses the South boundary line of the Northwest fractional quarter of said Section 1; thence in a Northerly direction along said Creek to the slough that runs parallel with and adjoins the Osage River; thence in a Northeasterly direction along said slough to a certain bluff known as the Hanging Rock Bluff; thence in a Southerly direction along the base of a hill, making the lowest ledge of rock at the base of said hill the line, to the South boundary line of the Northwest fractional quarter of said Section 1; thence West along said South boundary line to the point of beginning, and containing 4 acres, more or less.

Also, all that part of the Northeast quarter of the Southwest quarter and the Northwest quarter of the Southeast quarter of section one (1), Township forty (40), Range thirteen (13), lying south and west, of Missouri State Highway, Route "E", containing 20 acres, more or less. Also eleven and 80/100 (11.80) acres, more or less, being all that part of the North Part of the Northeast quarter of the Southwest quarter of section one (1), Township forty (40), Range thirteen (13), lying north of the Old Charleytown-Tuscumbia Public Road and west of the road leading therefrom to the Capps Cemetery, as said roads are now established, and containing in the aggregate 32 acres, more or less. SAVE AND EXCEPT, a parcel of land in the South part of the Southeast fractional quarter of the Northwest quarter and in the South fractional half of the Northeast quarter, all South of the Osage River, more particularly described as follows: Beginning at a point where the Southerly right-of-way line of State Highway Route 52 (formerly known as Route "E") intersects the South line of said Southeast fractional quarter of the Northwest quarter; thence in an Easterly direction along and with the Southerly right-of-way line of said Route 52 to a point in the South fractional half of the Northeast quarter where the West boundary line of the Old Tuscumbia and St. Elizabeth public road intersects the Southerly right-of-way line of said Route 52; thence in a Southwesterly direction along and with the West boundary line of said old Tuscumbia and St. Elizabeth public road to the South line of the South fractional half of the Northeast quarter; thence West along the subdivisional lines to the point of beginning. All the above described real estate being located in Section 2, Township 40, Range 13. ALSO, SAVE AND EXCEPT, a parcel of land located in Section 2, Township 40 North, Range 13 West, (South of the Osage River), in Miller County, Missouri, described as follows: From the Northwest corner of the Northeast quarter of the Southwest quarter of Section 2, Township 40 North, Range 13 West, run South along the subdivisional line to the Northerly right-of-way line of State Highway Route 52 (formerly known as Route "E"); thence in a Northeasterly direction along and with the Northerly right-of-way line of said Route 52 to an iron rod set at the base of an 8 inch Black Walnut tree, said Black Walnut tree standing on the Easterly line of a certain private road or driveway which runs in a Northwesterly direction to a dwelling now located in the Southeast fractional quarter of the Northwest quarter (South of the Osage River) of said Section 2, for point of beginning of the parcel of land hereby excepted; thence continuing in a Northeasterly direction along and with the Northerly right-of-way line of said Route 52, a distance of 600 feet; thence North, parallel with the West line of the Southeast fractional quarter of the Northwest quarter of said Section 2, to the Osage River; thence in a Westerly direction along said Osage River a distance of 600 feet, more or less, to a point which is directly North of the point of beginning, said point being marked by a stake approximately 12 feet from a large rock at low water; thence South, parallel with the West line of the Southeast fractional quarter of the Northwest quarter of said Section 2, to the point of beginning.

ALSO, SAVE AND EXCEPT, a parcel of land located in the Northwest corner of the Northeast quarter of the Southwest quarter and in the Southwest corner of the Southeast fractional quarter of the Northwest quarter, (South of the Osage River), in Section 2, Township 40, Range 13, described as follows: Beginning at the Northwest corner of the Northeast quarter of the Southwest quarter of said Section 2; thence South along the subdivisional line to the Northerly right-of-way line of State Highway Route 52 (formerly known as Route "E"); thence in a Northeasterly direction along and with the Northerly right-of-way line of said Route 52 to an iron rod set at the base of an 8 inch Black Walnut tree, said Black Walnut tree standing on the Easterly line of a certain private road or driveway which runs in a Northwesterly direction to a dwelling now located on the parcel hereby excepted; thence North, parallel with the West line of said Southeast fractional quarter of the Northwest quarter, to the Osage River; thence in a Westerly direction along said Osage River a distance of 558 feet, more or less, to the West line of said Southeast fractional quarter of the Northwest quarter; thence South along the subdivisional line to the point of beginning.

ALSO, SAVE AND EXCEPT, a parcel of land located in the north half, (south of the Osage River), of section 2, Township 40, Range 13, described as follows: From the northwest corner of the northeast quarter of the southwest quarter of section 2, Township 40, Range 13, run south along the subdivisional line to the northerly right-of-way line of state Highway Route 52 (formerly known as Route "E"); thence in a northeasterly, direction along and with the northerly right-of-way line of said, Route 52 to an iron rod set at the base of an 8 inch Black Walnut tree, said Black walnut tree standing on the easterly line of a certain private road or driveway which runs in a northwesterly direction to a dwelling now located in the southeast fractional quarter of the northwest quarter (south of the Osage River) of said Section 2; thence continuing in a northeasterly direction along and with the northerly right-of-way line of said Route 52, a distance of 828 feet, to the point of beginning of the parcel of land hereby excepted; thence continuing in a northeasterly direction along and with the northerly right-of-way line of said Route 52, a distance of 954 feet; thence north, parallel with the west line of the southeast fractional quarter of the northwest quarter of said section 2, to the Osage River; thence in a westerly direction along said Osage River to a point which is directly north of the point of beginning; thence south, parallel with the west line of the southeast fractional quarter of the northwest quarter of said section 2, to the point of beginning.

Said sale shall take place and be conducted at Miller County Courthouse, 2001 Hwy. 52, Tuscumbia, Missouri.
