Determination of Heirship

To: David A. Duncan, Melvin D. Duncan, Q. Brian Duncan, Lisa D. McDowell, James Robert Duncan, Christie A. Duncan, Wendy Moulitor, Jeremy Duncan and Melody Graves.

All unknown heirs of the decedent and all persons known or believed to claim any interest in the property outlined below as an heir or through an heir of the decedent.

You are hereby notified that you are entitled to appear and be heard at a hearing to be held on March 25, 2025, at 1:00 p.m. in the Probate Division of the Circuit Court of Miller County, Tuscumbia, Missouri 65082, on a petition to determine the heirs of the above-named decedent, who died on 09-DEC-2018, and their respective interests as heirs in the following described property.

Should you fail to appear, judgment and decree may be entered in due course upon said Petition.

Real Property (Including Legal Description)

All that part of the Southwest quarter of Section Twelve (12) Township Thirty-eight (38) of Range Fourteen (14) in Miller County Missouri, lying East of the Brumley and Crocker Road as located June 7, 1946, and containing Sixty (60) acres, more or less.

SAVE AND EXCEPT, the following land conveyed for State Highway Purposes in Right of Way Book 4, page 307, Miller County Recorder's Office:

All that piece or parcel of land situate in the North half (N1/2) of the Southwest quarter (SW1/4) and the Southeast quarter (SE/14) of the Southwest quarter (SW1/4) of Section 12, Township 38 North, Range 14 West, for supplementary

State Highway Route DD, described as: All the land of said Grantors which lies within a strip of land 35 feet wide, lying on the left or East side of, parallel to and adjoining the centerline of said Highway from Grantor's North property line opposite station 160+00 to station 163+51.7, a distance of 351.7 feet, thence gradually narrowing to a strip of land 30 feet wide at station 165+00, a distance of 148.3 feet, thence a strip of land 30 feet wide from station 165+00 to station 186+00, a distance of 2100 feet; thence gradually widening to a strip of land 40 feet wide at station 187+03.2, a distance of 103.2 feet; thence a strip of land 40 feet wide from station 187+03.2 to Grantor's East property line at station 190+87, a distance of 383.8 feet. Also, all the land of said Grantor's which lies within a strip of land 30 feet wide, lying on the right or West side of, parallel to and adjoining said centerline from station 170+00 to station 184+00 a distance of 1400 feet: thence gradually widening to a strip of land 80 feet wide at station187+03.2, a distance of 303.2 feet; thence narrowing to a strip of land 45 feet wide at station 187+03.2; thence a strip of land 45 feet wide from station 187+03.2 to station 191+87, a distance of 383.8 feet.

The centerline of said highway is described as follows: Beginning at a point 18 feet North of the Southeast (SE) corner of the Southwest quarter (SW1/4) of the Southeast quarter (SE1/4) of said Section 12 at station 204+32; thence North 88 degrees 44 minutes West, 559.7 feet; thence North 87 degrees 47 minutes West, 579.1 feet; thence on a 10 degree curve to the right 206.2 feet to station 190+87, the point of beginning; thence continuing on said 10 degree curve to the right 383.8 feet; thence North 28 degrees 47 minutes West, 583.5 feet; thence on a 5 degree curve to the left 304 feet; thence North 43 degrees 59 minutes West, 282.5 feet, thence on a 8 degree curve to the right 331.9 feet; thence North 17 degrees 26 minutes West, 849.6 feet; thence on a 4 degree curve to the left 351.7 feet to station 160+00.

Also, the right to construct drainage ditches and maintain same, if Grantee so desires, over strips of land described as follows: (1) a strip of land 30 feet wide, extending a distance of 30 feet, at an angle of 90 degrees left, from the left or East right-of-way line of said highway, centered opposite station 165+07; (2) a strip of land 30 feet wide, extending a distance of 30 feet, at in angle of 90 degrees left, from the left or East right-of-way line of said highway, centered opposite station 169+40; and (3) a strip of land 30 feet wide, extending a distance of 30 feet at an angle of 90 degrees left, from the left or East right-of-way line of said highway, centered opposite station180+75.

The land above described is shown by a copy of the plans for said highway on file with the clerk of the County Court of Miller County, Missouri.

ALSO SAVE AND EXCEPT, a parcel of land in the Southeast quarter of the Southwest quarter of Section 12, Township 38 North, Range 14 West of the 5th Principal Meridian, Miller County, Missouri, described as follows: Beginning at the South quarter corner of said Section 12; thence North 01 degrees East, 118 feet to a point on the North right of way of Highway DD, for a real point of beginning for the parcel herein described; thence North 54 degrees 28 minutes West, 183 feet along said Highway; thence North 42 degrees 12 minutes West, 85 feet; thence North 32 degrees West, 270 feet; thence leaving said Highway, South 89 degrees East, 353 feet; thence South 01 degrees West, 393 feet to the point of beginning and containing 2.21 acres, more or less.

ALSO SAVE AND EXCEPT, all of the Southwest quarter of Section Twelve (12) Township Thirty-eight (38) of Range Fourteen (14) in Miller County. Missouri, lying East of the Brumley and Crocker Road as located June 7, 1946, and West of Missouri State Highway "U".

Subject to all restrictions, reservations, conditions, easements and exceptions of record and to any roadways or power lines whether of record or not.
