NOTICE OF ABANDONMENT
OF BURIAL SITES
PURSUANT TO RSMo §214.209
Notice is hereby given that the City of Eldon, Missouri, pursuant to Section 214.209, RSMo, has determined that certain burial sites located within a municipally owned cemetery have been abandoned as defined by state law.
The burial sites subject to this notice are described as follows:
Old Block 10, Lot 1, Sites 2 through 10
In accordance with Section 214.209(1), RSMo, no interment has occurred in the above-described burial sites for a period exceeding seventy-five (75) years, and the City has been unable, after reasonable inquiry, to identify or locate any owner, heir, or person having a legal interest in said burial sites.
Pursuant to Section 214.209(2), RSMo, any person claiming an ownership interest or right of interment in the above-described burial sites must file a written claim with the City of Eldon within three hundred sixty-five (365) days from the date of the final publication of this notice. Claims must include documentation establishing ownership or legal rights to the burial sites.
If no valid claim is filed within the prescribed time period, Section 214.209(3), RSMo, provides that all rights, titles, and interests in the burial sites shall revert to the cemetery owner, being the City of Eldon, Missouri, and the burial sites may thereafter be used, conveyed, or maintained as permitted by law.
