NOTICE UPON ORDER FOR

SERVICE BY PUBLICATION

The State of Missouri to defendant Jacob Switzer.

You are hereby notified that an action has been commenced against you in the Circuit Court of Miller County, Missouri the object and general nature of which is a petition for injunctive relief for abatement of nuisance of illegal discharge of wastewater, and which effects the following described property, commonly known and addressed as 25 Treetop Lane, Rocky Mount, Missouri, to-wit:

A tract of land lying in the East half of the Northwest quarter of Section 15, Township 40 North, Range 16 West, Miller County, Missouri, and more particularly described as follows: Beginning at the Southeast corner of the Northwest quarter of the Northwest quarter of said Section 15 and running South O degrees 44 minutes East along the quarter quarter Section line, 79.0 feet; thence South 72 degrees 51 minutes East, 76.8 feet; thence North 72 degrees 08 minutes East 64.5 feet; thence North O degrees 43 minutes West, 83.5 feet; thence South 89 degrees 17 minutes West, 135.0 feet to the point or beginning.

ALSO a tract of land lying in the East half of the Northwest quarter of Section 15, Township 40 North, Range 16 West, Miller County, Missouri, and more particularly described as follows: From the Southeast corner of the Northwest quarter of the Northwest quarter of said Section 15, run South O degrees 44 minutes East, 267.6 feet to the Shoreline of Lake of the Ozarks; thence along and with said shoreline South 88 degrees 53 minutes East, 89.5 feet; thence

North 84 degrees 29 minutes East, 122.3 feet to the point of beginning; thence continuing along said shoreline North 79 degrees 38 minutes East , 99.4 feet; thence departing said shoreline North 44 degrees 14 minutes West 227.5 feet; thence South 72 degrees 08 minutes West; 50.0 feet; thence South 33 degrees 18 minutes East, 198.1 feet to the point of beginning.

SAVE AND EXCEPT A tract of land lying In the East half of the Northwest quarter of Section 15, Township 40 North, Range 16 West in Miller County, Missouri, being that part of the Janet V. Underwood tract described by instrument recorded in Deed Book 340, page 350 in the Office of the Miller County Recorder bounded and described as follows: Commencing at a 1 inch iron pipe monumenting the record position on the Northwest corner of the Southeast quarter of the Northwest of said Section and monumenting the Northwest comer of said Underwood tract; thence along the bounds of said Underwood tract as follows: South 2 degrees 09°28" West-79.0 feet (deed=South O degrees 44' East-79.0 feet) to a 1/2 inch iron rod; thence South 69 degrees 50'34" East-76.87 feet {deed=South 72 degrees 51' East-76.8 feet); thence North 75 degrees 08'59" East (deed=North 72 degrees 08' East) 41.55 feet to a cross cut at the POINT OF BEGINNING of the following described tract; thence continuing North 75 degrees 08' 59" East (deed=North 72 degrees 08' East) 41.71 feet to cross cut; thence South 41 degrees 13' 25" East 228.06 feet (deed= South 44 degrees 14' East. 227.5 feet) to a 1/2 inch iron rod; thence South 82 degrees 49' 27" West {deed= South 79 degrees 38' West) 67.47 feet to a 1/2 inch iron rod; thence leaving the bounds of said Underwood tract North 30 degrees 17' 01" West. 20.0 feet to a 1/2 inch iron rod; thence South 82 degrees 49' 27" West 23.3 feet to a 1/2 inch iron rod; thence North 30 degrees 17' 01" West 179.39 feet to the herein above described point of beginning.

The names of all parties to said action are stated above in the caption hereof and the name and address of the attorney for Plaintiff is: Matthew F. Howard, Prosecuting Attorney, P.O. Box 12, 2001 Highway 52, Tuscumbia, Missouri.

You are further notified that, unless you file an answer or other pleading or shall otherwise appear and defend against the aforesaid petition within 45 days after the 31st day of August, 2023, judgment by default will be rendered against you.
