NOTICE UPON ORDER FOR SERVICE BY PUBLICATION
The State of Missouri to the above-named or described Defendants:
YOU ARE HEREBY NOTIFIED that an action has been commenced against you in the Circuit Court for the County of Miller, State of Missouri, the object and general nature of which is to quiet title, and which affects the following described property:
A parcel of land located in the Southwest quarter of the Northeast quarter of section 31, Township 40 North, Range 15 West, described as follows, to-wit: From the Northwest corner of Lot 36 as shown on the plat of Arrowhead Club Division, filed in Miller County Plat Book, said point being 1585.6 feet South of North quarter corner of said Section 31; thence North 120.5 feet; thence South 67 degrees 06 minutes East 151.4 feet to a concrete right of way marker, said marker being located on the Northerly side and opposite centerline Station 117/00 of U.S. Route 54; thence South 62 degrees 24 minutes East 560.2 feet to a concrete right of way marker located on Northerly side and opposite centerline Station 122/53/7 (old deed 122/53.7) of U.S. Route 54; thence South 57 degrees 00 minutes East 441.6 feet along the Northerly right of way line of U.S. Route 54 for the point of beginning; thence continuing along said right of way line South 57 degrees 00 minutes East 34.4 feet; thence continuing along said right of way line on a 5 degree curve to the left 61.8 feet; thence North 29 degrees 18 minutes East 143.2 feet; thence North 57 degrees 00 minutes West 70.3 feet; thence South 55 degrees 27 minutes West 43.1 feet; thence South 33 degrees 00 minutes West 104.6 feet to the point of beginning and containing .25 of an acre, more or less.
Subject to an easement allowing the use of the front 5 feet of said real estate lying along said right of way line of U.S. Route 54 for the construction and maintenance of a water pipe line. (hereinafter the “Property”)
The names of all of the parties to said suit are stated above in the caption hereof, and the name and address of the attorney for Plaintiff is Derek L. Smith, Curran & Associates, 4427 Osage Beach Parkway, Suite A100, Osage Beach, Missouri 65065.
YOU ARE FURTHER NOTIFIED that, unless you file an answer or other pleading or shall otherwise appear and defend against the aforesaid petition within forty-five (45) days after the first day of publication, judgment by default will be rendered against you.
It is further ordered that a copy hereof be published according to law in The Eldon Advertiser, a newspaper of general circulation published in the County of Miller, State of Missouri.
